3. Eligibility
To use our services, you must be at least 18 years old and have the legal authority to enter into a binding agreement. You also represent that the information you provide is accurate and complete.
4. Service Availability and Changes
We strive to ensure our services are available and functional. However, Convertico reserves the right to modify, suspend, or discontinue any of our services at any time, without prior notice. We are not liable if any part of our service is unavailable at any time.
5. Client Responsibilities
As a client, you are responsible for providing the necessary materials, information, and access required to perform the services. You agree to:Cooperate with Convertico in a timely and efficient manner.
Ensure that all content provided for advertising or campaigns complies with applicable laws and does not infringe on third-party rights.
Provide accurate business and financial information during our consultation and onboarding process.
6. Payment Terms
Convertico operates on a payment structure agreed upon in writing (via email, proposal, or contract). All payments must be made according to the schedule outlined in your agreement with Convertico.Late payments may incur interest at a rate of 2% per month. In case of non-payment, Convertico reserves the right to suspend or terminate services.
7. Refunds and Cancellations
Refunds are not available for services already rendered. However, if you wish to cancel any ongoing service, you must provide written notice at least 30 days in advance. Any cancellation made without such notice may still be subject to the full service fee.
8. Intellectual Property
All content, design, and materials produced by Convertico during the provision of services remain the intellectual property of Convertico unless otherwise agreed upon in writing. Clients are granted a non-exclusive, non-transferable license to use the materials for their intended purposes.
9. Confidentiality
Both parties agree to maintain the confidentiality of any sensitive or proprietary information shared during the course of business. This includes business data, strategies, financial information, and other materials not available publicly.
10. Limitation of Liability
Convertico is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability, in any case, is limited to the amount paid by you for the specific services that caused the dispute.
11. Indemnification
You agree to indemnify, defend, and hold harmless Convertico and its employees from any claims, damages, losses, or liabilities arising out of:Your breach of these Terms and Conditions.
Your violation of any law or regulation.
The materials you provide for use in any advertising, campaigns, or marketing efforts.
12. Termination
Convertico reserves the right to terminate or suspend services at any time if the client violates any of the terms herein. Additionally, clients may terminate their contract by providing 30 days' written notice, subject to any outstanding payments for services rendered up to the date of termination.
13. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from the use of our services or this agreement will be subject to the exclusive jurisdiction of the courts of South Africa.
14. Amendments to Terms
Convertico reserves the right to amend these Terms and Conditions at any time. Any changes will be posted on our website, and it is your responsibility to review these terms periodically. Continued use of our services after any changes constitutes your acceptance of the updated terms.
